2. DEFINITIONS
Terms: these general terms and conditions of sale.
Client: any natural person (aged 18 or older) or legal entity that places an order intending to enter into a sales contract concerning the products (“you”, “your”).
Demsky Jewellery: Demsky Jewellery BV, as defined in Section 1 (“we”, “us”, “our”).
Products: tailor-made or made-to-order jewellery pieces listed for sale on our website (including standard collection, limited edition, and unique designs).
Parties: collectively refers to the Client and Demsky Jewellery.
3. SCOPE OF APPLICATION
The most current version of these Terms is accessible on our website under “General Terms and Conditions.” The Terms are available in English only.
Before completing an order, Clients receive access to the Terms to enable them to read and understand them fully. By placing an order, you confirm that you have reviewed, comprehended, and accepted these Terms without reservation. The Terms will also be sent to you via email together with your order confirmation. We advise you to save a copy for future reference.
These Terms govern every order placed through our website, all offers, all distance sales agreements, and all invoices issued by Demsky Jewellery. They also apply to all agreements concluded remotely, even if you had initial in-person contact with us (for instance, at a private appointment or event) but finalized the contract online. Unless explicitly agreed otherwise in writing, these Terms override any other conditions. By accepting these Terms, you explicitly renounce your own or any third-party general terms and conditions.
Only legally competent individuals aged at least 18 may place orders. Minors must act through their parent(s) or legal guardian(s). By accepting these Terms, you confirm your legal capacity to enter into agreements.
4. OFFER, ORDER PROCESS, AND ACCEPTANCE
The presentation of our Products on our website, including any visuals or promotional materials, is for informational purposes only and does not constitute a binding legal offer. The information aims to allow you to make an informed purchase decision. While we strive for accuracy, errors, omissions, or inaccuracies may occur. We are not bound by obvious mistakes or clerical errors.
To submit an order, add desired items to your shopping cart, proceed to checkout, provide your billing and delivery details, review your summary, choose a shipping method, and accept the Terms. Finally, select your payment method and confirm your order by clicking the button indicating your payment obligation. For assistance, you may contact us by phone or email.
You commit to supplying current and accurate purchase and account details. Please keep your information updated to ensure successful transactions and communication.
Products labeled as "limited edition" or "unique" are subject to specific terms and availability, clearly indicated in the offer. We cannot be held liable for unavailable items. In the event we cannot accept your order, you will be notified in writing and receive a prompt refund of any payments made, within seven business days. This refund serves as full settlement and does not accrue interest.
Your order is considered complete upon meeting all order requirements, including payment and acceptance of these Terms. The sales contract is concluded upon receipt of our written order confirmation.
5. OUR PRODUCTS
Natural versus lab-grown diamonds
We offer both naturally sourced diamonds and lab-grown diamonds. Natural diamonds are formed over millions of years underground, whereas lab-grown diamonds are created in controlled laboratory conditions using advanced technology, making them physically and chemically identical to natural diamonds but with a lower environmental footprint. Natural diamonds are valued for their rarity and long-term worth.
Diamond certification
White diamonds from 0.50 ct onwards include certification from GIA, IGI, HRD, or comparable institutes. Smaller diamonds may be certified upon request at an extra charge.
6. PRODUCTION AND DELIVERY TIMELINES
Production starts only after receiving written confirmation of your order, referencing your invoice, and upon full payment.
We always aim for swift production and delivery.
Average production time is approximately ten (10) weeks but may vary depending on design complexity and gemstone availability.
Shipments within Belgium generally take up to 4 business days; neighboring countries (Netherlands, France, Germany, Luxembourg) may take up to 5 business days; other destinations can require up to 15 business days.
These timelines are indicative and not binding. If you have a specific delivery deadline, please consult us before placing your order to avoid disappointment.
Unless agreed otherwise, the final delivery deadline is twelve (12) months from written order confirmation.
7. SIZING
Rings
If you do not know your ring size, we recommend the following:
Option 1: Order a ring sizer by email (shipping costs apply).
Option 2: Measure an existing ring that fits the intended finger. Remember that finger sizes may vary depending on the hand and temperature. In doubt, opt for a slightly larger size.
If an incorrect size is ordered:
Most rings can be resized within four (3) sizes up or down.
For gifts (e.g., engagement rings), the first resizing is complimentary (including return and shipping costs within Belgium and the Netherlands).
For subsequent resizings, a fixed fee applies.
Bracelets: Measure wrist circumference with a flexible tape or string, adding 1–2 cm for comfort. If gifting, choose a medium size unless specific information is known.
Earrings: Usually one-size-fits-all; check diameter for hoops or huggies.
Necklaces: Measure desired length with a flexible tape or string. A standard length of 45 cm suits most preferences.
8. PRICES
Prices listed include VAT and insurance during transport but exclude shipping costs.
Shipping fees will be displayed during checkout before finalizing your order.
9. SHIPPING FEES AND INSURANCE
Demsky Jewellery provides complimentary ground shipping within Belgium and the Netherlands. Shipping fees for other destinations are available upon request.
Orders are shipped via our insured courier service.
10. PAYMENT AND INVOICE
Full payment is required when placing your order. Cash payments are accepted up to €3,000 per order.
Accepted payment methods include:

Payments are processed in euros (EUR). We use secure systems to protect electronic data and transactions. We are not responsible for delays or failures caused by declined payments.
11. CLEANING INSTRUCTIONS
We recommend cleaning your jewellery every two weeks to maintain its brilliance.
Professional cleaning or polishing can be requested at an additional charge.
12. CARE GUIDELINES
- Cleaning: Use mild soap or jewellery cleaner with warm water and a soft brush or cloth. Avoid harsh chemicals.
- Storage: Keep pieces in a dry, cool place, preferably in individual pouches or compartments.
- Wearing: Remove jewellery during manual activities and before applying cosmetics or lotions.
- Handling: Avoid forceful pulling or impact. Inspect pieces regularly for loose stones or wear.
- Professional maintenance: Consider periodic professional inspections and cleaning.
13. WARRANTY
Goods must be checked immediately upon receipt. Any visible defects must be reported to us in writing within 48 hours, otherwise you lose your right to recourse.
Complaints for visible defects are only valid if the item hasn’t been used or worn.
Hidden defects must be reported within eight (8) days of discovery and no later than six (3) months after delivery.
We may repair, replace, or reduce the price, depending on the case. Improper use voids the warranty. Work by external jewelers without our written approval also voids it.
Consumers’ statutory warranty: Consumers enjoy a two-year warranty under Belgian law, with specific reporting deadlines.
14. REPAIR
Repairs beyond warranty are carried out at cost. Contact us before returning any item. Ship with insurance and clear labeling. We disclaim liability for transit damage due to poor packaging.
15. EXCLUSION OF RIGHT OF WITHDRAWAL
15.1. Customized and personalized goods
Due to the personalized and custom-made nature of certain products (such as made-to-order designs or pieces made to customer specifications), the legal right of withdrawal is excluded in accordance with Article VI.73, 3° of the Belgian Code of Economic Law. This means that these customized goods cannot be canceled, exchanged, or returned once an order has been confirmed and production has started.
15.2. Standard (Non-Customized) Goods
For non-customized, non-personalized items, Demsky Jewellery voluntarily offers an extended return period of thirty (30) days from the date of delivery, provided that:
- The item is returned in its original condition, unworn and unused, with all original tags attached, and in its original packaging.
- The return request is submitted in advance to info@demsky-jewellery.com, and the return instructions provided are followed.
- Proof of purchase (receipt or order confirmation) is provided.
Returns sent without prior approval will not be accepted.
15.3. Exclusions
The following items are excluded from return and exchange:
- Custom-made or personalized items.
- Sale items or items purchased with promotional discounts.
- Gift cards.
15.4. European Union Right of Withdrawal
If your order is delivered within the European Union and relates to non-customized goods, you retain the legal right to withdraw from the contract within fourteen (14) days without providing any reason, as stipulated by the EU Consumer Rights Directive and Belgian Code of Economic Law.
15.5. Refunds
Refunds will be processed within ten (10) business days after the return has been received and approved, and in any case no later than fourteen (14) days after receipt of the returned goods. Refunds will be issued to the original payment method.
16. LIABILITY
We are only liable for direct damage resulting from intent or gross negligence. Our liability is capped at the value of the order. We are not liable for indirect losses.
17. FORCE MAJEURE
We are not liable for failure to perform due to unforeseen events (e.g., natural disasters, strikes, pandemics, supplier issues).
18. PRIVACY
We process your data according to our Privacy Policy available on our website.
19. QUESTIONS, FEEDBACK, AND COMPLAINTS
Contact us by email or phone for any feedback or complaints.
20. SEVERABILITY
Invalid provisions will not affect the validity of the rest. The parties shall replace such provisions with valid ones that best reflect the original intent.
21. MISCELLANEOUS
Headings are for reference only and do not affect interpretation.
22. JURISDICTION AND GOVERNING LAW
Belgian law governs these Terms and all related agreements. Disputes fall under the exclusive jurisdiction of the Dutch-speaking courts of Antwerp.
